1. About These Terms
These Terms and Conditions govern your use of the SSX website, mobile applications and related services.
SSX is operated by Surplus Stock Xchange Limited, a company registered in England and Wales under company number 17083771. Our registered office is 9 The Broadway, Great Central Road Unit NG18 2RL
By creating an account, listing an item, purchasing an item, using the Technical Forum or otherwise using SSX, you agree to these Terms.
If you do not agree to these Terms, you must not use SSX.
Nothing in these Terms limits any legal rights that cannot lawfully be limited or excluded.
2. Who Can Use SSX
You must be at least 18 years old and capable of entering into a legally binding contract.
You may register as a private individual or on behalf of a business. If you register for a business, you confirm that you have authority to bind that business.
You must provide accurate, current and complete information. You must update your information if it changes.
You must correctly identify whether you are acting as a private seller, business seller or buyer. A person who regularly sells as part of a trade, business, craft or profession must not describe themselves as a private seller.
3. What SSX Does
SSX provides an online marketplace for surplus, obsolete, reclaimed and other trade-related stock, equipment, materials and vehicles.
Unless SSX is expressly identified as the seller, items are offered by independent third-party sellers. The contract for the sale of an item is between the buyer and the seller.
SSX is not the manufacturer, owner or supplier of items listed by third-party sellers. SSX does not inspect every item and does not guarantee its condition, safety, authenticity, legality, suitability or fitness for a particular purpose.
Listing approval, account information, trade body registration details and moderation checks do not amount to an endorsement or guarantee by SSX.
SSX may facilitate payment, communication, disputes, refunds and seller payouts, but this does not make SSX the seller of an item.
4. Accounts and Security
You are responsible for keeping your account and login details secure.
You must not share your account, allow another person to impersonate you or create accounts using false information.
You are responsible for activity carried out through your account unless you have notified SSX promptly that it has been compromised.
SSX may ask for identity, business, tax or payment verification. Sellers may be required to complete payment-provider verification before receiving payouts.
Trade body names and registration numbers supplied by users are self-declared unless SSX expressly marks them as verified.
5. Seller Responsibilities
A seller must:
- Have the legal right to sell every item listed;
- Provide accurate photographs, descriptions, quantities, prices and condition information;
- Disclose known faults, damage, missing parts, repairs, modifications and safety issues;
- Select the correct category and product attributes;
- State whether VAT applies and use an accurate VAT rate;
- State whether returns are accepted, without attempting to remove statutory rights;
- Provide realistic dispatch, delivery or collection information;
- Keep stock quantities accurate;
- Remove or update unavailable items promptly;
- Package items appropriately for transport;
- Comply with applicable product safety, environmental, waste, export, tax and consumer laws;
- provide safety information, warnings, manuals and compliance markings where legally required; and
- Cooperate with recalls, investigations, returns and disputes.
Business sellers must provide buyers with all information and rights required by consumer and distance-selling law where the buyer is a consumer.
A seller remains responsible for their listing and item even where SSX has reviewed or approved the listing.
6. Product Photographs and Identifiable Markings
Sellers should upload clear public photographs that accurately show the item being sold.
Sellers may also upload private photographs of serial numbers, part numbers and other identifiable markings. These photographs are not normally displayed to buyers.
SSX may retain and review identifiable-marking photographs for fraud prevention, erroneous-return investigations, disputes, legal claims and platform safety.
Selling without providing appropriate evidence of identifiable markings may make it more difficult for a seller to establish that a returned item is different from the item originally supplied.
Sellers must not upload images containing unnecessary personal information, access credentials, private documents or unrelated individuals.
7. Prohibited Items and Conduct
You must not list, buy, sell, advertise or request:
- Stolen, unlawfully obtained or fraudulently described items;
- Counterfeit items or items that infringe intellectual property rights;
- Recalled, unsafe or legally non-compliant products;
- Asbestos-containing materials or hazardous waste;
- Explosives, ammunition, prohibited weapons or illegal substances;
- Controlled drugs, prescription-only medicines or medical products sold unlawfully;
- Items carrying an undisclosed finance interest, lien or ownership dispute;
- Products with removed or falsified safety, serial or compliance markings;
- Personal information, login credentials or access-control credentials;
- Items whose sale, possession or transport would be unlawful; or
- Anything else prohibited by SSX’s published policies.
You must not:
- Manipulate reviews, feedback, search results or platform activity;
- Make false claims about qualifications, accreditations or trade registrations;
- Harass, threaten, discriminate against or abuse another user;
- Send spam, malware or fraudulent payment requests;
- Use SSX to facilitate crime or unsafe activity;
- Attempt to bypass fees or payment protections by moving an SSX transaction off-platform;
- Scrape, reverse-engineer or interfere with the platform; or
- Create misleading duplicate listings.
SSX may remove content, suspend accounts and report suspected illegal activity to the appropriate authorities.
8. Buying an Item
Buyers must review the full listing, seller information, price, VAT, condition, delivery or collection terms and returns information before ordering.
Buyers are responsible for deciding whether an item is suitable for their intended installation or use. Safety-critical, gas, electrical, pressure, lifting and similar equipment should be inspected and installed by a suitably competent person where appropriate.
An order is not guaranteed merely because an item has been placed in a basket. Stock is reserved only as part of the checkout and payment process.
A binding sales contract normally arises between buyer and seller when payment is successfully confirmed and SSX issues an order confirmation.
SSX may cancel or reverse an order where payment fails, stock is unavailable, fraud is suspected, the listing is unlawful or a clear pricing error has occurred.
9. Prices, VAT, Fees and Boosts
Sellers set their item prices and are responsible for the accuracy of their VAT treatment.
The total payable by the buyer, including applicable VAT and shipping, is displayed before payment.
Creating an account and a standard listing is currently free.
SSX deducts a marketplace commission from seller proceeds. The current commission is 9.5% plus VAT, calculated on the discounted item subtotal. The applicable fee will be shown to the seller and recorded against the order.
Optional listing boosts are charged at the price shown before purchase. A boost increases placement or visibility but does not guarantee views, enquiries or a sale.
SSX may change fees for future transactions by giving reasonable notice. A fee change will not retrospectively alter a completed order.
10. Payments and Seller Payouts
Payments are processed through Mollie or another payment provider identified at checkout.
SSX does not normally receive or store complete payment-card details.
Sellers may be required to create and maintain a connected payment account and complete identity, business and bank verification.
Seller proceeds may be held until the buyer confirms receipt or the platform’s confirmation period expires without an unresolved issue.
SSX may delay, hold, reverse or offset a payout where:
- A payment is disputed, cancelled, reversed or charged back;
- A buyer raises an issue;
- A refund or return is being considered;
- Fraud or unlawful activity is suspected;
- The seller’s payment account is restricted;
- Required information has not been supplied; or
- SSX is legally required to do so.
Payment-provider processing and banking times are outside SSX’s direct control.
11. Delivery and Collection
The seller is responsible for offering accurate fulfilment options and completing delivery or collection as agreed.
For shipping orders, the seller must package the item appropriately and dispatch it within the stated timeframe. Tracking information should be provided where available.
For collection orders, buyer and seller are responsible for agreeing a safe time and place. Buyers should inspect the item before removing it where reasonably possible.
The allocation of risk during delivery is determined by applicable law and the buyer-seller contract. Business sellers remain responsible for consumer deliveries to the extent required by consumer law.
SSX is not a courier and is not responsible for the acts or omissions of an independent shipping provider, although SSX may assist with an investigation.
12. Cancellations, Returns and Statutory Rights
A seller’s stated returns policy is additional to, and does not replace, any statutory rights.
Where a business seller sells at a distance to a consumer, the consumer may have a legal right to cancel without giving a reason, normally within 14 days after receiving the goods. Exceptions may apply to certain goods.
Consumers may also have rights where goods are faulty, unsafe, not as described or not fit for purpose.
A listing stating “returns not accepted” cannot remove rights that apply by law.
Different rules may apply to:
- A sale between two businesses;
- A sale by a private individual;
- Goods made to order or personalised;
- Sealed hygiene-sensitive products;
- Perishable products; and
- Products damaged after delivery.
Buyers should notify the seller and SSX promptly and keep the item, packaging and supporting evidence.
Unless SSX agrees otherwise, refunds must be processed through the original SSX payment route. Users must not arrange a refund in a manner designed to bypass the transaction record.
13. The SSX Issue and Dispute Process
Buyers should use the SSX order screen to report non-delivery, damage, the wrong item, an item not as described, missing parts, suspected counterfeiting or another material issue.
The current platform confirmation period is 48 hours after fulfilment. Raising an issue during that period pauses automatic seller payout while the matter is reviewed.
The 48-hour period is an SSX payout-protection process. It does not remove or shorten any statutory, contractual or legal rights that continue beyond that period.
SSX may request photographs, documents, tracking information, messages and private identifiable-marking evidence.
SSX may decide to:
- Release the seller payout;
- Require a return;
- Provide a full or partial refund;
- Cancel the order;
- Continue holding funds while further evidence is obtained; or
- Refer the parties to the payment provider or relevant authority.
SSX’s platform decision does not prevent either party from exercising legal rights outside the platform.
14. Trade Vehicles
Vehicle sellers must accurately disclose ownership, condition, mileage, transmission, engine details, known faults, roadworthiness and any outstanding finance or material accident history.
The seller must have the right to transfer the vehicle and must complete all legally required ownership and registration steps.
SSX does not inspect vehicles, check mileage, guarantee roadworthiness or confirm that a vehicle is free from finance unless expressly stated.
Buyers should conduct appropriate history, finance, identity and mechanical checks before collection or use.
15. Messages and Technical Forum
Messages, forum posts, answers and other user content are provided by users, not SSX.
Technical Forum content is general information and must not be treated as professional, engineering, installation, safety or regulatory advice.
Users must not post unlawful, abusive, dangerous, misleading, infringing or fraudulent content.
Users should report inappropriate content using the available reporting tools or by contacting SSX Support.
SSX may moderate, restrict or remove content and may preserve relevant evidence where necessary for safety, complaints or legal obligations.
16. User Content and Intellectual Property
You retain ownership of content you upload.
You grant SSX a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format and display that content for operating, promoting and protecting the platform.
You confirm that you have the necessary rights to upload the content and that it does not infringe another person’s rights.
The SSX name, branding, software, design and platform content belong to SSX or its licensors and may not be copied or commercially reused without permission.
17. Suspension and Termination
SSX may restrict, suspend or close an account where it reasonably believes that a user has:
- Breached these Terms;
- Created a safety, fraud or legal risk;
- Failed required verification;
- Failed to pay an amount due;
- Misused another person’s information;
- Repeatedly failed to fulfil orders; or
- Acted in a way likely to harm other users or SSX.
Where appropriate, SSX will explain the action and provide a way to contact Support.
Account closure does not affect existing orders, disputes, fees, refunds, payouts or legal obligations.
18. Availability and Changes
SSX aims to provide a reliable service but does not guarantee uninterrupted or error-free availability.
We may maintain, update, replace or withdraw features. We will provide reasonable notice of material changes where practical.
19. Liability
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot lawfully be excluded.
If you are a consumer, SSX is responsible for losses that are a foreseeable result of SSX breaching these Terms or failing to use reasonable care and skill. SSX is not responsible for losses that are not foreseeable or are caused by a buyer or seller.
If you use SSX for business purposes, SSX will not be liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss of anticipated savings.
Subject to liabilities that cannot legally be limited, SSX’s total liability to a business user will not exceed the greater of £100 and the total SSX fees paid by that user during the 12 months before the event giving rise to the claim. This limit does not reduce any amount that SSX is properly required to return or pay to a user.
SSX is not responsible for the quality, safety, legality or performance of an item supplied by an independent seller.
20. Privacy
Our Privacy Policy explains how SSX processes personal information.
Buyers and sellers who receive another user’s personal information must use it only for the relevant transaction, delivery, collection, legal obligation or dispute. They must not use it for unsolicited marketing.
21. Changes to These Terms
SSX may update these Terms to reflect legal, operational or platform changes.
We will publish the updated version and its effective date. We will provide reasonable notice of material changes where appropriate.
Changes do not retrospectively alter completed sales unless required by law or agreed by the affected parties.
22. Governing Law
These Terms are governed by the laws of England and Wales.
Consumers living in Scotland or Northern Ireland retain any mandatory rights to bring proceedings in their home courts.
Business users agree that the courts of England and Wales will have exclusive jurisdiction.
